OUTSTAX Copyright Policy

This copyright policy (“Copyright Policy”), forming part of the Website Terms and Conditions, sets out how OUTSTAX users are permitted to use Website content without the requirement to purchase additional licences and also recourse in cases of infringements.

What is a copyright?

Copyright is the legal right of the owner of intellectual property. Copyright law gives creators of original material the exclusive right to further use and duplicate that material for a given amount of time.

Term of copyright

In terms of the provisions of section 22 of the Copyright Act 1957, copyright shall subsist in any literary, dramatic, musical or artistic work published within the lifetime of the author until sixty years from the beginning of the calendar year next following the year in which the author dies.

Fair Use

Laws across the globe exempt use of copyrighted works as “fair use” in certain circumstances and recognises that strict application of copyright laws in such cases would be prejudicial to the interests of the public. Few examples for such fair use are the reproduction of any work:

  1. for private or personal use, including education and research;
  2. for review of that work or of any other work;
  3. for reporting of current events and current affairs;
  4. for the purpose of a judicial proceeding;
  5. in a newspaper, magazine or other periodical; and
  6. in accordance with any law for the time being in force.

Such use enables the user to use a copyrighted material without permission or licence of the creator.

Licenses and permissions

Without necessary authorisations/ licenses, users are prohibited from content that someone else owns the copyright to, such as music tracks, snippets of copyrighted programmes or videos made by other users.
